ORDER

This matter having come before the Court on the Receiver’s Response to Certain Account Holders’ Motions For Exclusion that Fall Into Certain Uncontested Categories, it is hereby ORDERED:

1. The accounts listed on Exhibit A hereto are EXCLUDED from the allocation of the cash trust fund shortage on the basis that they were: (a) never in cash; (b) had a zero account balance on April 23, 1999 (i.e. the account was first funded after April 23, 1999); and/or (c) were bookkeeping accounts only.

2. The accounts listed on Exhibit B hereto are EXCLUDED from the allocation of the cash trust fund shortage on the basis that they were not opened under after April 23, 1999.

3. The accounts listed on Exhibit C hereto are EXCLUDED from the allocation of the cash trust fund shortage on the basis that they were bookkeeping accounts only.
