ORDER
This matter having come before the Court on the Motion of N.G.N.G., Inc. to Exclude Intrust Account No. 985564 from Allocation of the Shortage, it is hereby ORDERED:
Movant's March 26, 1999 deposit of $2,000,000 is not considered to be de minimus and shall be included in the allocation, including appreciation; and
Movant's post-April 23, 1999 deposits (including appreciation thereon) shall be excluded from the allocation.
