Graham of Levin & Funkhouser, Ltd., Chicago, Illinois, representing certain appealing accounts, has filed a motion with the Illinois Supreme Court. The Justices are reviewing these motions and there is no indication when a ruling will be made. Because, technically there is no stay (only an emergency motion requesting a stay), Millennium Trust Company, LLC will file a motion with the Illinois Supreme Court asking for instructions on how to proceed. Millennium expects to file this motion on December 4, 2001. Tuesday, November 27, 2001: On November 27, 2001, the Appellate Court affirmed the Final Allocation Order. The Court's order allowing a receivership fee was reversed and remanded for further proceddings consistent with the Appellate Courts's opinion.To read the Appellate Court's Order, click here to go to the menu [Read Release] Thursday, November 15, 2001: In a ruling released Friday the Illinois Appellate Court has extended the stay order, staying the release of restrictions on the fiduciary accounts until November 29, 2001.
